2. Eligibility and Account Obligations

You must be at least 18 years old, or the legal age of majority in your jurisdiction, and have legal capacity to enter a binding contract.

• You must provide complete and accurate account details.
• You must keep login credentials confidential and secure.
• You remain responsible for all actions taken under your account.
• You must promptly report suspected account compromise.
• You represent and warrant that your use of the Services does not violate sanctions, export controls, or other applicable law.

3. Service Scope and Product Nature

FlyoSIM plans are prepaid digital products that enable mobile data access through partner carrier networks. Coverage, quality, and speed depend on carrier availability, destination infrastructure, and device/network conditions.

• Plan descriptions specify destination coverage, data allowance, and validity period.
• Service quality may vary by location, local congestion, and handset radio capabilities.
• Some destinations may require manual APN, roaming toggle, or profile reset steps.

4. Device Compatibility and User Responsibilities

Before purchase, you must confirm your device is eSIM-compatible, carrier-unlocked, and technically suitable for the selected plan and destination.

Customers are responsible for confirming that their device supports eSIM technology and is carrier unlocked prior to purchase.

• Unsupported or locked devices may fail to install or activate eSIM profiles.
• Dual-SIM conflicts and device software settings are managed by the user.
• Installation instructions must be followed for successful provisioning.

5. Order Formation and Delivery

A contract is formed when payment is successfully authorized and FlyoSIM confirms the order. Digital delivery occurs by providing plan credentials and activation instructions in-app and/or by email.

• Order confirmation includes purchased package details and transaction reference.
• All products are delivered digitally; no physical SIM card shipment is provided.
• Delivery may be delayed if verification, risk checks, or provider-side incidents occur.
• We may decline or cancel orders where fraud or legal risk is identified.

6. Payment, Merchant of Record, and Billing

Payments are processed by licensed third-party payment processors and, where applicable, Merchant of Record partners. Checkout terms, payment methods, tax treatment, sanctions controls, and invoice/receipt handling may be administered by those providers in accordance with their legal and network obligations.

• Payment authorization is required before plan delivery.
• You authorize charge of the full checkout amount to your selected payment method.
• Risk, fraud, sanctions, or compliance checks may result in delayed settlement, request for verification, or transaction decline.
• Invoices/receipts should be retained for support, accounting, and dispute handling.

7. Pricing, Fees, Taxes, and Currency

Pricing varies by destination, plan size, validity, partner costs, and market conditions. Applicable taxes and disclosed service fees are shown at checkout before payment confirmation.

• Final total shown at checkout controls over marketing previews.
• Currency conversion may involve issuer or bank rates/charges outside FlyoSIM control.
• Promotions can be time-limited and subject to specific eligibility terms.
• Catalog pricing may change at any time and typically applies to future orders only.

8. Digital Delivery

FlyoSIM products are delivered digitally. After successful payment authorization, customers receive an eSIM activation QR code or installation profile within their FlyoSIM account or by email. No physical SIM cards are shipped.

9. Activation, Validity, and Expiration

Plan validity starts according to plan rules shown at purchase, commonly on first network usage in covered destinations or within any stated activation window.

• Data allowance and validity are fixed per purchased package.
• Unused data typically expires with plan validity unless local law requires otherwise.
• Expired plans may require a new plan purchase.
• Activation timing, roaming settings, and device configuration remain the user’s responsibility.

10. Acceptable Use and Prohibited Conduct

You agree not to misuse Services or use them for unlawful or abusive activity.

• Fraud, synthetic identities, deceptive transactions, or chargeback abuse.
• Unauthorized resale, credential sharing, or commercial redistribution.
• Security testing, scraping, traffic manipulation, malware, or service disruption attempts.
• Use in violation of sanctions, export controls, telecommunications law, or payment network rules.
• Any use associated with prohibited goods/services under applicable payment partner policies.
• Any use intended to circumvent billing controls, exploit promotions, or misrepresent identity or location.

11. Compliance, Sanctions, and Risk Controls

We may perform verification and transaction risk checks to meet legal and payment-compliance requirements, including fraud prevention, sanctions screening, and abuse detection.

Our services are not available in restricted jurisdictions including Iran and Syria, and any other jurisdiction restricted by applicable sanctions, export controls, or payment-partner compliance rules.

We may suspend, restrict, or terminate access where sanctions exposure, legal restrictions, policy violations, or serious payment risk is identified.

12. Service Availability and Third-Party Dependencies

Services depend on partner carriers, cloud infrastructure, and payment systems. We do not guarantee uninterrupted operation or uniform speeds across all destinations.

• Planned maintenance may affect checkout, activation, or account access.
• Carrier outages or force majeure events may impact connectivity quality.
• Support timelines may vary during major provider incidents.

13. Refunds and Cancellations

Refund handling is governed by our Refund Policy and applicable consumer law. Refund decisions may consider activation status, usage evidence, technical findings, and transaction risk.

14. Chargebacks and Dispute Resolution Process

Before filing a payment dispute, contact support to allow remediation and verification. Where chargebacks are filed, FlyoSIM may provide order, delivery, and usage evidence to payment processors.

• False or abusive disputes may result in account restrictions.
• Users must cooperate with reasonable troubleshooting and evidence requests.
• Evidence may include order metadata, activation records, usage indicators, device diagnostics, and support correspondence.

15. Intellectual Property

FlyoSIM trademarks, software, content, and materials are owned by FlyoSIM or its licensors and protected by applicable intellectual-property laws.

You receive a limited, revocable, non-exclusive license to use the Services in accordance with these Terms.

16. Privacy and Data Processing

We process personal data in accordance with our Privacy Policy for service operation, checkout, fraud prevention, support, and legal compliance.

17. Disclaimer of Warranties

To the fullest extent permitted by law, Services are provided "as is" and "as available" without express, implied, or statutory warranties, including fitness for a particular purpose, uninterrupted service, or universal device compatibility.

18. Limitation of Liability

To the maximum extent permitted by law, FlyoSIM is not liable for indirect, consequential, special, incidental, exemplary, or punitive losses, including lost profits, revenue, data, or goodwill.

Where liability cannot be excluded, FlyoSIM aggregate liability is limited to the amount paid for the specific order that gave rise to the claim during the 12 months prior to the event, except where mandatory law requires a higher standard.

19. Indemnity

You agree to indemnify and hold harmless FlyoSIM and its affiliates from claims, damages, and expenses arising from your misuse of Services, policy violations, unlawful conduct, or infringement of third-party rights.

20. Suspension and Termination

We may suspend or terminate access for legal, compliance, security, or operational reasons, including fraud, sanctions risk, repeated policy violations, and abuse.

Termination does not cancel obligations accrued prior to termination, including payment and dispute cooperation duties.

21. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles, except where mandatory consumer protection law in your residence jurisdiction cannot be waived.

22. Changes to These Terms

We may update these Terms for legal, operational, or product reasons. Updated versions are posted on this page with a revised "Last updated" date. Continued use after updates constitutes acceptance of the revised Terms.
